Re-trial avoided after plea deal reached in Mark Sperber case

GREEN BAY, WI (WTAQ) - A plea deal has been reached by a man ahead of a re-trial for a 2011 fatal hit-and-run crash.

On Monday, Mark Sperber entered an Alford plea. That means Sperber maintains his innocence but acknowledges there is enough evidence for a conviction.

On January 25, 2011, Sperber was the driver in a vehicle versus wheelchair crash that killed 20-year-old John Kennedy. Sperber says he thought he hit a trash can, not a person. An appeals court ruled that the jury wasn't properly instructed on what Sperber knew of the crash at the time it happened and ordered a re-trial.

Defense attorney Brian Maloney told FOX 11 that a plea deal was reached on Monday. Sperber pled no contest to the same charge after prosecutors agreed not to seek any more prison time that what he's already served, according to Maloney.

Sperber served about 25 months in prison before being released.
