Judge again rules to put brakes on John Doe investigation into Walker recall

MILWAUKEE (WTAQ) - For the second time in three days, a federal judge has ordered a halt to the John Doe probe into campaign activities for the state recall elections.  

Thursday morning, Judge Rudolph Randa decided that a separate appeal by prosecutors to keep the investigation going was frivolous -- and therefore his preliminary injunction from Tuesday went back into place.  

In that appeal, prosecutors claimed they were immune from a federal civil rights suit filed by the Wisconsin Club for Growth, one of the targets of the John Doe.

Randa has ruled earlier that the prosecution was not immune from a federal lawsuit. The state appealed that ruling -- and its pending status was cited by a three-judge federal appeals court panel Wednesday as a reason to re-instate the John Doe.  

Randa said Thursday the prosecution's separate appeal was indeed frivolous. The nearly two-year-old John Doe probe is looking into allegations of illegal campaign coordination between outside groups and Republican recall election candidates in 2011 and '12 -- including Governor Scott Walker.
