UPDATE: Refunds for same-sex marriage licenses given in Outagamie County


APPLETON, WI (WTAQ) - After initially denying a full refund to same-sex couples in Outagamie County who applied for marriage licenses, those couples will now get all $100 back.

According to Outagamie County Executive Tom Nelson's office, he will refund the $45 county fee from his budget. Clerk Lori O'Bright first told the couples they would refund $55 that would've gone to the state, but keep its share for services rendered.

At least 10 couples planned to get married Monday morning, since it would have marked the end of the 5-day waiting period before couples in Outagamie County could wed.

Shortly after U.S. District Judge Barbara Crabb’s initial ruling to allow same-sex marriages, Wisconsin Attorney General J.B. Van Hollen requested Crabb to put her ruling on hold, arguing that allowing the marriages while the underlying case was pending created confusion about the legality of those marriages.

Crabb’s ruling puts an end to gay marriages while the appeal from Van Hollen is pending. Couples who were in the middle of the five-day waiting period to get a license, which most counties waived, are caught in limbo.
