Walker Administration won't file same-sex marriage licenses with Vital Records office

UNDATED (WSAU)  The Walker Administration will delay processing the paperwork that would finalize same-sex marriage licenses. Those licenses will be held by the Department of Health Services Vital Records Office until there are further court rulings on the issue.

Normally once a couple is married their completed marriage license is filed with the state -- the final step in the marriage process. For now the health department is not processing same-sex marriage licenses that are forwarded by county clerks' offices. About half of Wisconsin's county clerks have been issuing licenses to same-sex couples. Others are waiting for additional legal guidance.

Meanwhile, a federal appeals court will not decide until tonight at the earliest whether gay marriages in Wisconsin should be put on hold.The 7th Circuit Court of Appeals in Chicago has asked both sides to submit legal briefs by 5 p.m. After that, a three-judge panel is expected to consider the state Justice Department's request to delay Federal Judge Barbara Crabb's ruling, which said the state's gay marriage ban is unconstitutional.

The Justice Department has also asked Crabb to put her decision on hold until it's appealed. She'll hold a hearing on that request June 19th.
