Judge refuses to drop lawsuit against Badger Guns

MILWAUKEE (WTAQ) - A judge refused Thursday to throw out a lawsuit against a gun shop that were linked to a weapon used in shooting two Milwaukee police officers.

Bryan Norberg and Graham Kunisch were both permanent disabled in 2009 when they were shot by suspect Julius Burton, using a gun that another man bought for him. Burton was sentenced to 80 years in prison.

The officers later sued Badger Guns, its predecessor Badger Outdoors, and their owners.

A judge dropped a claim that the businesses were public nuisances. Charges of negligence, conspiracy, and aiding and abetting on the gun stores' part are still pending.

Circuit Judge Jeffrey Conen said Thursday that neither side would clearly win the case, and he sent the matter to a jury for a three-week trial planned for September.

A federal agency revoked Badger Guns' license -- and the former owner's brother later reopened the place with another name and a promise to be more selective in its gun sales.
