Judge: State commissioners held in contempt of court over Act 10

MADISON, WI (WTAQ) - Two state commissioners were held in contempt of court Monday afternoon, for continuing to make school and local government unions hold recertification elections under Act 10. 

Judge Juan Colas ruled 13 months ago that the 2011 public union bargaining limits did not apply to the Madison teachers' union and a Milwaukee city employee union. 

Since then, Colas said the dismissal of Act 10 applied to all local and school unions statewide -- and today, he ordered members of the Wisconsin Employment Relations Commission to halt around 400 recertification votes planned in the near future. 

The Walker administration contended that federal court rulings in other cases allowed the state to proceed -- at least for those unions other than the plaintiffs in the Colas case. 

Colas ruled otherwise, and said his rulings in the case apply statewide. 

State employees must continue abiding by Act 10. The local and school unions clearly scored a victory, but it might not last for long. 

The State Supreme Court has agreed to review Colas' original decision from last September. The justices will hear arguments in that case November 11th.
