APPLETON, WI (WTAQ) - A husband and wife have now been both officially charged in Outagamie County after falsely claiming their child had terminal cancer and took advantage of the generosity of a Fox Valley race car driver.   

38-year-old Lynette Dougherty from Glasgow, Kentucky  was charged with felony theft last week. 

Her husband Robert waived his right to a preliminary hearing Monday. 

The race car driver paid for a van rental and arranged a three-day hotel stay for the family to see a local race.  The driver also bought the family a used minivan. 

Fans also donated after hearing the family’s story.
