OSHKOSH, WI (WTAQ) - An Oshkosh man has decided not to plead insanity to the brutal murder of a woman during a drug robbery.

21-year-old Donald Martin is accused of killing 22-year-old Emily Wayman with a hammer last year at her apartment, reportedly because he was in a rage and he needed drugs to feed an addiction.

Martin was supposed to go on trial in April. But a judge ordered a psychiatric exam, after his lawyer brought up the possibility of pleading insanity.

The exam did not produce enough evidence that Martin was insane at the time of the slaying. Attorney Linda Meier said she would not ask for a second opinion and Martin is pleading not guilty.

The trial has been re-set for October 25th on charges of homicide and armed robbery. Martin is in jail under a $1 million cash bond.
